Deceptive marketing: CCP imposes Rs 1.25m fine on Reckitt Benckiser Pakistan

The Competition Commission of Pakistan (CCP) has issued an order imposing a fine of PKR 1.25 Million on Reckitt Benckiser Pakistan Limited for running a deceptive television commercial for its household cleaning product Dettol Surface Cleaner that was misleading the consumers and harming the business interests of Reckitt’s competitors in violation of Section 10 of the Competition Act, 2010. 

The order has been passed by a bench comprising Vadiyya Khalil Chairperson, Mueen Batlay Member Mergers & Acquisitions, Dr. Shahzad Ansar Member OFT & Advocacy, and Mr. Ikram Ul Haque Qureshi, Member Cartels & Trade Abuses, and Legal.

The order disposes off the proceedings arising out of the show cause notice issued to Reckitt after a CCP inquiry found it to be in prima facie violation of Section 10 of the Act. CCP had initiated the enquiry into the matter after taking notice of a televised marketing campaign for Dettol Surface Cleaner. The marketing campaign made four distinct claims with regards to the efficacy of the product, which are as follows:

  • ‘Phenyl is highly ineffective against germs’;
  • ‘Only Dettol Surface Cleaner can kill more germs than Phenyl’;
  • ‘Dettol Surface Cleaner can kill 99.9% of germs’; and
  • ‘Dettol Surface Cleaner can kill germs 10 times more than Phenyl’.

With regards to the first claim, Reckitt submitted that the claims were based on a comparative disinfectant efficacy study carried out by its own laboratories between Dettol Surface Cleaner and unbranded ordinary phenyl. The order found that the study did not substantiate the claim against all types and brands of phenyl, and is thus misleading and capable of harming the business interests of phenyl manufacturers. In relation to the second claim, CCP’s order reasons that in the absence of a comparison with other surface cleaners available in the market, it would not be appropriate to say that only Dettol Surface Cleaner can kill germs more than Phenyl.

Regarding the third claim, the order holds that while the term germs includes all disease carrying microorganisms such as bacteria, virus, fungi, and protozoa etc, the product has only been tested against three species of bacteria. Furthermore, the conditions required for Dettol Surface Cleaner to achieve 99.9% efficacy in a laboratory are appreciably different from those present in common households. This makes the claim misleading for the consumers. Concerning the fourth claim, the order states that the Study only substantiated the claim with respect to unbranded ordinary phenyl, hence the claim is capable of misleading consumers and harming the business interest of Reckitt’s competitors.

The order specifies that these claims constitute five distinct violations of Section 10 (1) read with Section 10(2) (a), (b) and (c) of the Act. Since M/s Reckitt Benckiser Pakistan Limited has made commitments to rectify three of the claims made, CCP has taken an extremely lenient view and imposed a token penalty of PKR 250,000 only for each violation. Through the order, CCP has directed Reckitt to pick a suitable alternative to the fourth claim of ‘Kills 99.9% of Germs’ within thirty days and file a compliance report with the Commission. If the undertaking fails to amend the outstanding claim within the time period stipulated, it will be liable to pay PKR 5 Million for the violation relating to this claim, in addition to facing possible non-compliance proceedings. Reckitt has been reminded that deceptive marketing practices in the future may entail stricter penal consequences.

It is pertinent to mention here that it is important to enforce the prohibition against deceptive marketing not just to protect the end-consumers from anti-competitive behaviour, but to also safeguard competitors from false and misleading marketing that can severely harm business interests. CCP believes in creating a level playing field where all play fairly and by the rules envisioned by competition law.

Independence Day: Pakistan Embassy organizing Photography Exhibition in Ankara

ANKARA, 12 August 2015: As part of Independence Day celebrations, the Embassy of Pakistan in Ankara is organizing a Photography Exhibition in collaboration with the Ankara Metropolitan Municipality.

The Exhibition, titled “Colours of Pakistan — Seen Through the Eyes of Turks” will be held at the Metro Sanat Galerisi, Kızılay, Ankara and continue through 14-21 August 2015. The Exhibition features the works of Veli UÇMAZ, Ahmet ERKAN, Tunç FINDIK, Mehmet OKUTAN and Fethi ETEM.  On the sidelines, video documentary on Pakistan prepared by Mr. Levent Recep ÖZTÜRK would be on display. The Opening ceremony on 14 August 2015 envisages remarks by the participating photographers.

ECC extends wheat export deadline to Sept 30, Khi-Lhr Motorway and KKH-II approved

The Economic Coordination Committee of the Cabinet today approved the proposal moved by the Ministry of National Food Security and Research for extension in the period for export of surplus wheat from Punjab and Sindh provinces till 30th September 2015. In an earlier decision on January 20th2015, ECC had allowed the export of 8,00,000 M/tons of wheat by the government of Punjab at the transport rebate of US$ 55 per M/ton and 400000 M/T of wheat by the Government of Sindh at the transport rebate of US$ 45 per M/ton. Later on 9th February, the ECC also allowed export of wheat flour (aata) with specific time lines. However, in view of further requests from Pakistan Flour Mills Association, the date for export of wheat and wheat flour has been extended till 30th September 2015.

The Federal Minister for Finance, Senator Mohammad Ishaq Dar chaired the meeting of Economic Coordination Committee of the Cabinet (ECC) here Wednesday.

ECC also approved the exemption of 5% sales tax on wheat bran. The Chairman FBR informed the Chair that flour, the main product of the flour industry was exempt from sales tax and imposing a tax on its byproduct, bran was creating an anomaly which had to be removed. Accordingly, the ECC allowed the exemption of sales tax on bran.

ECC considered proposal by the Ministry of Communication for grant of EPC (Engineering design, procurement and construction) contracts to the firms recommended by the Government of China through competitive bidding for the KKH Phase-II and Karachi-Lahore Motorway projects being undertaken by NHA. The ECC expressed its concurrence, noting that the mechanism for such projects was already covered under article-II of the Framework Agreement signed by Pakistan and China in April with the approval of the competent authority.

The Economic Coordination Committee of the Cabinet also granted approval for the issuance of Sovereign Guarantee by the Ministry of Finance in respect of syndicated term finance facility amounting to Rs. 7.487 billion for the power sector.

ECC had a detailed discussion on the proposal submitted by Ministry of Food Security and Research regarding pending payments to PASSCO by Afghanistan Government for supply of wheat. The meeting approved the claim as prepared by PASSCO and also accorded approval for the payment to M/s Abdullah Khan and Imranullah Khan, hired by PASSCO for transportation of wheat. It may be recalled that Pakistan and Afghanistan had signed an agreement in 2008 for supply of 50,000 MT of wheat to Afghanistan.

ECC discussed Automotive Development Policy 2015-20 and Telecommunications Policy 2015, giving directions to line ministries to resubmit the policies for approval after incorporating the improvements as suggested by the forum.

KARACHI: The Security agencies have busted gang from Karachi and Hyderabad that planned terrorist attacks on the Independence Day in Karachi, ISPR said on Wednesday.

Deputy emir of the Tehreek-i-Taliban Pakistan (TTP) Swat chapter, Bakht Zaman is also among the arrested terrorists.

Mazar QuaidAccording to details by ISPR, the TTP gang had prepared an explosive-laden vehicle and motorcycle, which they wanted to use on August 14.

The arrested suspects have confessed that the vehicles were arranged in Karachi and they (militants) were waiting for suicide-bombers to reach Karachi from Afghanistan to carry out large-scale terrorism on Independence Day. They revealed that Bakht Zaman had traveled to Afghanistan to arranger for the bombers.

1428 Indian Army officers get early retirement

On an average more than one Army officer is daily getting premature retirement. Indian defence minister, in his response to the status of vacancies in the armed forces, said the Army has 9,642 vacant officers’ positions and 23,909 vacancies among other ranks. Navy has 1,179 officer vacancies and 11,653 vacant slots for sailors; the Air Force has 6,664 airmen slots vacant.

DEHRADUN, India: For over three years now, one officer from India’s defence forces has quit each day. The largest number of officers seeking early retirement from the armed forces belong to the Army.

These facts were shared by defence minister Manohar Parrikar in a written response to a query raised in Parliament by BJP MP from Haridwar, Ramesh Pokhriyal Nishank. Raising a question in Parliament, Nishank sought to know details of vacancies in the armed forces. In March this year, answering a query raised in the Rajya Sabha, Parrikar had said that the armed forces faced shortage of over 11,000 officers.

In his written response to Nishank, the defence minister said that in 2012, 564 officers opted to exit before their set date of retirement; in 2013, 448 officers sought early retirement, and in 2014 the number was 319. So far, in 2015, 97 officers have opted for premature retirement.That in effect is more than an officer retiring prematurely every day in the last three and half years, TOI reported on Wednesday.

The highest number of those seeking to quit were from the Army, at 664 between 2012 and 2015. Retired Lt General KK Khanna, sharing his concern over the large number of early exits from the armed forces, said, “Dissatisfaction simmers when officers are overlooked for promotion. There are fewer vacancies in the higher ranks, and only those high in merit have assured career progression. This sometimes nudges officers to quit and pursue something else.”

Khanna, a former commandant of the Indian Military Academy, Dehradun, said this was compounded by the fact that there is these days no dearth of opportunities for officers wishing to pursue a career, for instance, in the aviation industry or merchant navy. “Dissatisfaction, however, is not confined to the mid-level, colonel-rank officers. It is present even among higher levels,” Khanna said.

Besides the aviation sector and the merchant navy, officers with experience in the armed forces also find attractive opportunities in the corporate sector and industry, fuelling premature retirement plans. Retired Brigadier AN Acharya said: “The glory and charm of service in the armed forces has taken a hit for many reasons. Even if one were to retire as general, there are many things one loses out on, in the end. Those who still have time in their favour, at the middle of their careers, might opt for a corporate job or pursue education to re-skill themselves for entry into the service sector or business.”

The defence minister, in his response to the status of vacancies in the armed forces, said the Army has 9,642 vacant officer positions and 23,909 vacancies among other ranks. Navy has 1,179 officer vacancies and 11,653 vacant slots for sailors; the Air Force has 6,664 airmen slots vacant. The minister’s response showed that over 68,331 recruits were under training for the Army; there are 2,247 trainees set to enter the Navy, and 6,152 the Air Force.

Such a huge number of officers quitting the armed forces on a regular basis should ring alarm bells. When they leave, a lot of time, effort and money spent on training them goes at least partly waste. The forces need to figure out a way of lowering the attrition rate. The problem must be thoroughly studied and ways found to incentivise people to stay. After all, what is at stake is no less than the defence of the nation.
